Terms, Conditions and Privacy Policy for entry to the Samudra Art Prize and exhibitions 2026

These Terms, Conditions and Privacy Policy ('the Terms') apply to your entry of a maximum of one artwork ('the Work(s)') (which can be comprised of multiple parts) in Samudra Art Prize ('SAP') online on the Samudra Art Prize ('SAP') website and/or on-site at the Caudan Arts Centre (CAC). 'You' and 'Your' shall refer to the person submitting the Work(s) as either:
  • the artist/ creator of the work.
  • a parent /guardian/ teacher (with authorisation of a parent or guardian) for artists under 18 years. If you are under 18, you must ask your parent/ guardian/ teacher to create an account and submit your work on your behalf.
Please read these Terms carefully before completing Your entry form (‘the Entry Form’) as the Entry Form and these Terms, will together form the contract between You and SAI/ CAC.
  1. Samudra Art Initiative Ltd (SAI).
    1. Samudra Art Initiative Ltd is a company limited by guarantee registered in Mauritius with number 181653.

  2. The Samudra Art Prize (SAP)
    1. The Samudra Art Prize (SAP) is organised by The Samudra Art Initiative Ltd (SAI) in conjunction with the Caudan Arts Centre (CAC).
    2. The Samudra Art Prize will be:
      1. a) an online website available to the public;
      2. b) an online competition; and
      3. c) an online gallery and an on-site exhibition of the final selected Works.
  3. The Work(s) and Images
    1. The Work(s) and or Images must be your own original work and not a copy.
    2. The Work(s) must not pose a health and safety risk.
    3. The following types of Work(s) are not allowed:
      1. a) Work(s) which contain obscene or defamatory content or material.
      2. b) Work(s) that are in breach of copyright.
    4. By submitting Your Work(s), You confirm:
      1. a) that the work(s) is in a condition to withstand normal handling and display by SAI/ CAC.
      2. b) that the Work(s) will not affect the rights of any other person.
    5. If You do not own all of the rights, title and interest in and to the Work(s), you must expressly inform SAI in writing.
  4. Artist Profile and Submission Forms
    1. These online forms will contain all the details we require to process your application and must be completed accurately.
    2. You are required to abide to registration conditions as stated in these Terms. SAI will not consider an application as valid in case of any condition lacking and/or breach, default, fraud in the registration process.
  5. Categories and conditions for participating
    1. One of the aims of Samudra Art Prize is to promote and reward Mauritian artists, so You must be a Mauritian national or a resident of Mauritius to take part in the competition.
    2. You must submit your work through one of the 3 categories below:
      1. a) Open: main category with access to all prizes (except Young Artist), for 18 years and above.
      2. b) Young Artist: for 15–19 year-olds.
      3. c) Hors-Concours: for artists who do not wish/ are not eligible to take part in the competition, but who would like their work to be considered for the online and on-site exhibitions (18 years and above).
    3. International foreign artists, not resident in Mauritius are not eligible for the competition. However they can submit work through the Hors-Concours category.
  6. Prizes for 2026
    1. Open category prizes will be in the form of cash and artist residencies.
    2. Young Artist category prizes will be in the form of a custom art workshop with a professional artist for the winner and a number of finalists. Please note that if a winner/ finalist is unable to attend the workshop, their place will be awarded to the next runner-up.

  7. Submission of Your Work(s)
    1. Open and Hors-Concours categories: only one Work per artist.
    2. Young Artist category: Only one Work per artist.
    3. For each work You should upload a minimum of 3 images as follows:
      - One main image showing the entire work, including all parts if it is presented in multiple parts.
      - One image showing the relative scale of the work, for example photographed next to a hand, a chair, or a person seen from the back.
      - One or more detailed images, such as: a close-up of a 2D Work; or for sculpture or other 3D Works, photographs taken from different angles.
    4. A work in multiple parts must be submitted as a single work.
    5. Most visual arts mediums are acceptable (eg drawing, painting, printmaking, collage, mixed media, photography, video, digital, animation, street art, sculpture, installation, ceramics, textile, embroidery...)
    6. When submitting your work, you will be requested to select, through the submission form, the discipline that best reflects your work. Some works may be difficult to categorise and you are therefore encouraged to contact the SAP’s team for guidance prior to submission. In any case, SAI reserves the right, at its sole discretion, to adjust or reclassify the discipline of any submitted work in the back-office or submission system in order to ensure fairness and consistency. You understand and agree that, should SAI determine that the initial classification is not appropriate or does not accurately reflect the nature of your work, any such reclassification will be made directly by SAI in your best interest and with the aim of avoiding any disadvantage in the judging process. You may be informed by SAI of such change in a timely manner. SAI’s decision regarding the appropriate discipline shall remain final. You agree that any adjustment or reclassification of discipline by SAI shall not constitute grounds for any claim, complaint, dispute, or legal action against SAI.
    7. A project proposal may be accepted for certain types of works, where the final creation is to be produced only if the proposal is selected. Any such proposal should be presented in a high enough standard, sufficiently detailed and compelling to allow the selection committee/jury to fully appreciate the concept, ambition and feasibility of the work.
    8. A work may be submitted by a group of artists.
    9. If you submit a work under your own name, you may still participate in a group work, provided that the group work is submitted under the name of another participating artist who is not submitting any other individual work.
    10. You can submit a new work or a recent existing work (created within the last 10 years), as long as it was not selected for a previous edition of the Samudra Art Prize. Older works may be submitted through the Hors-Concours category.
    11. Work(s) larger than 2m wide x 2m high must be approved by SAI.
  8. Refusal or Withdrawal of your Work(s) by the SAI
    1. SAI may accept or decline any Work(s) submitted for the SAP that appear to breach copyright law, any laws or regulations, the reputation of SAP/ CAC or these Terms.
    2. The SAI's decision is final.
  9. Selection and independent Jury Panels
    1. All submitted works will be seen by the SAP/CAC Selection Panel. This panel is responsible for selecting the works for the on-site exhibition at the Caudan Arts Centre and for the online gallery on the SAP website.
    2. Selected works will be allocated a reference number in order to remain anonymous, and sent to the Jury panels for the selection of finalists and prize-winners.
    3. The Jury will use a point-based system with a minimum of two rounds. For the selection of the winners, the jury panels may be invited to view the actual works during the exhibition installation, in order to decide on the finalists and winners.
    4. Jury members' names may remain undisclosed until the winners have been declared, to avoid any external pressure.
    5. If the Jury does not find a good enough work for a particular prize, they may choose not to award the prize.
    6. An artist can only win 1 prize per edition. This limitation does not apply to artist residencies, which are awarded through separate selection processes and are entirely independent from SAP.
    7. SAI reserves its right to disqualify You at any time during SAP, for dishonesty, voting fraud, obscene language, offensive behaviour, non-compliance with the copyright or any similar intellectual property rights and/or contravention of any of these Terms.
    8. The SAP/ CAC Selection Panel and the SAP Jury Panels' decisions are final.
  10. Curation of the Exhibition at the Caudan Arts Centre
    1. The curation of the exhibition is the sole responsibility of SAI/ CAC.
    2. Artists are not entitled to choose where their work will be positioned during the exhibition.
  11. Delivery and retrieval of your Work from the Caudan Arts Centre
    1. No Work that has been accepted and displayed at the on-site exhibition may be removed prior to the close of the exhibition.
    2. You will be responsible for delivering and retrieving your original artwork/s according to an established schedule.
    3. Le Caudan Arts Centre cannot be held responsible for works delivered/ retrieved outside of the allocated times and works which are not retrieved after the exhibition.
  12. Framing and glazing
    1. All works on paper and other fragile works must be framed or mounted. Artworks can be glazed and framed, using a simple, neutral frame in white, black or natural wood. Alternatively, they may be dry-mounted onto board/ metal or sandwiched between perspex sheets.
    2. Clip frames are not acceptable.
    3. Your work must be clearly labelled on the back, with your name and category. If your work comprises more than one part, each part must be labelled, and the arrangement of the work must be clearly indicated.
  13. Use of Your data
    1. The SAI will comply with the Data Protection Act 2018 and associated legislation and process your data in accordance with the SAI's privacy policy, updated from time to time https://www.samudraartprize.com.
    2. The Samudra Art Prize webpage has been created and is owned by Samudra Art Initiative Ltd.
    3. By applying to the SAP, You agree that you have read and accept to be bound by the Terms of this clause 12. As a consequence, You expressly give your consent and agree to the disclosure of Your personal data by SAI to members of the public.
    4. Your personal data includes information such as your name, postal address, email address, phone number.
    5. Your personal data will be collected and processed in a legal and fair manner, for the following purposes only:
      (1) Process your application for entry to SAP, (2) Communicate with you and (3) Advertising and marketing opportunities. It is clearly understood that given the nature of the SAP, your identity and some other personal data as deemed necessary and agreed by You, may be disclosed to members of the public for advertising and marketing purposes.
  14. Permission for the SAI/CAC to use your Work(s) and/or reproductions of Work(s) and/or Image(s)
    1. You grant the SAI/ CAC a non-exclusive, worldwide, royalty free, irrevocable licence in perpetuity to use, reproduce, modify, edit, publish and distribute your Images for archival, educational, publicity, website, press and signage purposes, including through use of mobile applications and social networking sites.
    2. You grant SAI/CAC a non-exclusive, worldwide, royalty free, irrevocable licence in perpetuity to sub-licence the rights set out in Clause 13.1 for the purposes of allowing mobile applications and social networking sites to host, use, distribute, modify, run, copy, publicly perform or display, translate and create derivative works of Your Work(s)/ Images on their sites.
    3. By submitting a Work(s)/ Image, You agree that members of the public will be allowed to take photographs of the Work(s) (alone or in combination with other Work(s) for personal and non-commercial use during the exhibition period. SAI/ CAC will not be responsible if any such images of the Work(s) are exploited commercially in violation of the permission given.
  15. Permission for the SAP sponsors to use your Work(s) and/or reproductions of Work(s) and/or Image(s)
    1. You grant the sponsors of the Samudra Art Prize reproduction rights to Your Work(s): filming, broadcasting and/or reproducing the whole or any part of the Work(s) for archival, educational, publicity and marketing (including without limitation on their Website, posters and billboards and all forms of social media), press.
  16. Copyright
    1. Artists who have opened an online account retain ownership of all of their copyrights regarding the works of art and information contained in their application form.
    2. The finalists and winners grant SAI/CAC a free right to reproduce the content of their artist's profile and submission form for an unlimited period of time. This right is limited to communications made by SAI/CAC (press releases, publications on the website and on social media, publications at the Caudan Arts Centre, etc).
  17. Personal data
    1. SAI/CAC ensure that no personal information will be requested from candidates that is not truly useful for reviewing their application.
    2. Candidates agree and accept that their personal data will be processed electronically by SAI under Mauritian law, concerning the protection of individuals with regard to the processing of personal data.
    3. In the Artist's Profile and Submission Forms, applicants are asked to expressly agree to the electronic processing of this data by checking the acceptance box.
    4. Applicants have a right to access, object to and rectify data concerning them in the personal accounts reserved for each applicant.
    5. Candidates accept and agree that their personal information will be communicated to third parties pursuant to application of the law or for the normal organization of the Samudra Art Prize.
    6. Candidates are free to delete their candidate space at any time by clicking on the 'Delete my account' button provided for this purpose.
  18. The Samudra Art Prize website
    1. While SAI endeavours to ensure that the Samudra Art Prize website is available 24 hours a day, SAI will not be liable if for any reason the webpage is unavailable in part or whole at any time or for any period.
  19. Sale of work(s)
    1. For the purposes of any sale of your work, the role of SAI is strictly limited to indicating that the work is for sale. The CAC shall be responsible for handling the sale of works selected for the SAP and exhibited at the CAC. In such cases, all sale-related services, administrative formalities and contractual arrangements will be managed exclusively by CAC. You will be required to enter into a separate agreement directly with CAC, which shall govern the terms and conditions of any such sale. SAI shall not be liable for any disputes or claims relating to the sale of your work.
    2. If you are provided with contact details (including personal data) solely for the purposes of completing and fulfilling the purchase, you agree to comply with all applicable data protection laws when processing such personal data. Please note that SAI and CAC will not have obtained any consent for you to send marketing or promotional communications, and you must independently obtain such consent should you wish to contact the individual for such purposes in the future. You agree that you shall not use such personal data for any purpose other than completing the sale, unless and until the necessary consents have been lawfully obtained.
  20. Limitation of Liability
    1. The CAC/SAI shall have no liability to You whatsoever for any loss or damage howsoever caused.
    2. The CAC/SAI shall not be liable for any deterioration or wear and tear to the Work(s), or any loss, damage or destruction (including damage to frames) through the ordinary course of handling the Work(s).
  21. Insurance
    1. You shall purchase and maintain with financially sound and reputable insurers, an insurance cover against any liability that may be asserted against, or expenses that may be incurred by any person and/or the art works during the SAP.
  22. Third Parties
    1. No third party shall have any rights under or in relation to these Terms.
  23. Force Majeure
    1. For the purposes of these Terms, a Force Majeure Event means an event beyond the reasonable control of SAI/CAC. SAI/ CAC shall not be liable to You under these Terms as a result of a Force Majeure Event.
  24. Severance
    1. If a court finds any of the Terms invalid, illegal or unenforceable, that particular Term shall be deemed deleted, and the validity and enforceability of the other Terms shall not be affected.
  25. Entire Agreement
    1. These Terms contain the whole agreement between the parties relating to the subject matter of this agreement at the date hereof to the exclusion of any terms.
  26. Law and Jurisdiction
    1. These Terms and the contract of which they form part shall be governed by and construed in accordance with Mauritian law. Any disputes arising in relation to these Terms shall be subject to the exclusive jurisdiction of the courts of Mauritius.
  27. Terms, Conditions and Privacy Policy
    1. SAI reserves its right to modify, amend and/or vary the present Terms at its discretion. In such case, SAI will use its best endeavours to inform You accordingly, but the onus remains on you to regularly review the website and the Terms to be informed about any latest modification, amendment and/or variation thereto.
  28. Acceptance
    1. By ticking the acknowledgement of Terms, Conditions and Privacy Policy box, You acknowledge that You have read and agree with the above Terms, and particularly You hereby give your express consent to your personal data collection and processing according to clause 12 in the manner and for the purposes as stated therein.
