Terms, Conditions and Privacy Policy


These Terms, Conditions and Privacy Policy (‘the Terms’) apply to your entry of up to three artworks (‘the Work(s)’) in Samudra Art Prize (‘SAP’) online on the Samudra Art Prize (‘SAP’) website and/or on-site at the Caudan Arts Centre (CAC). ‘You’ and ‘Your’ shall refer to the person submitting the Work(s) as either:
a) the artist/ creator of the work.
b) a parent /guardian for artists under 18 years. If you are under 18, you must ask your parent/ guardian to create an acount and submit your work on your behalf.
Please read these Terms carefully before completing Your entry form (‘the Entry Form’) as the Entry Form and these Terms, will together form the contract between You and SAI/ CAC.

  1. Samudra Art Initiative Ltd (SAI).
    1.1 Samudra Art Initiative Ltd is a company limited by guarantee registered in Mauritius with number 181653.

  2. The Samudra Art Prize
    2.1 The Samudra Art Prize is organised by The Samudra Art Initiative Ltd in conjunction with the
    Caudan Arts Centre.
    2.2 The Samudra Art Prize will be:
    a) an online website available to the public;
    b) an online competition; and
    c) an online gallery and an on-site exhibition of the final selected Works.
  3. The Work(s) and Images
    3.1 The Work(s) and or Images must be your own original work and not a copy.
    3.2 The Work(s) must not pose a health and safety risk.
    3.3 The following types of Work(s) are not allowed:
    a) Work(s) which contain obscene or defamatory content or material.
    b) Work(s) that are in breach of copyright.
    3.4 By submitting Your Work(s), You confirm:
    a) that the work(s) is in a condition to withstand normal handling and display by SAI/ CAC.
    b) that the Work(s) will not affect the rights of any other person.
    3.5 If You do not own all of the rights, title and interest in and to the Work(s), You must expressly inform SAI in writing.
  4. Artist Profile and Submission Form
    4.1 These online forms will contain all the details we require to process your application and must be completed accurately.
    4.2 You are required to abide to registration conditions as stated in these Terms. SAI will not consider an application as valid in case of any condition lacking and/or breach, default, fraud in the registration process.
  5. Categories
    5.1 You must submit your work through one of the 3 categories below:
    a) Best Artist 2022 for experienced or professional artists.
    b) Best Amateur Artist 2022 for aspiring artists, non-professional artists or students enrolled in creative courses (art/design/architecture etc) at tertiary level.
    c) Best Young Artist 2022 for 15–19 year-olds.
  6. Prizes for 2022
    6.1 Best Artist. Cash prizes for 1 winner (Rs80,000) and 1 finalist (Rs40,000).
    6.2 Best Amateur Artist. Vouchers for art workshops and art materials for 1 winner (value Rs45,000) and 3 finalists (value Rs25,000 each).
    6.3 Best Young Artist. 1 winner and 4 finalists win a 5 day custom art workshop (total value for 5 artists Rs120,000) at CAC and MCB savings accounts for each. Please note that if a winner/ finalist is unable to attend the workshop, their place will be awarded to the next runner-up.
    6.4 Special Prizes, will be open to all Selected works for 1 winner per prize:
    a) Best Painting: Rs50,000.
    b) Best Sculpture/installation/ ceramics: Rs50,000.
    c) Best Photography/ video: Rs50,000.
    d) Best Street Art Proposal: Rs50,000 commission for painting a wall (wall and paint supplied).
    e) Best Portrait: 5 day portrait workshop with an international artist at Artspace Mauritius worth Rs22,000.
    6.5 People’s Choice Award: Rs10,000 for most popular work, by popular vote on the SAP website.
  7. Conditions for participating
    7.1 You must be at least 15 years old by 31 May 2022.
    7.2 Young Artist and Amateur categories, as well as Special Prizes: you must be resident in Mauritius.
    7.3 Best Artist category: you must be resident in Mauritius or a Mauritian national (if living outside Mauritius).
    7.4 Works by international non-Mauritian artists may be accepted for the online gallery and on-site exhibition, but cannot be entered in the competition. You will be responsible for dispatching your work to us and retrieving it afterwards.
  8. Submission of Your Work(s)
    8.1 You may submit up to three Works and/or Images.
    8.2 You may submit one main image and up to two additional ‘detail’ images per Work. ‘Detail’ images may be a close- up image of a 2D work, or in the case of sculpture or other 3D works, photographs of the Work from different angles.
    8.3 You may submit a diptych or a triptych as a single work.
    8.4 Most visual arts mediums are acceptable (eg drawing, painting, printmaking, collage, mixed media, photography, video, street art (project proposal), sculpture, installation, ceramics, textile art, embroidery…)
    8.5 Your may submit a recent existing work.
    8.6 Work(s) larger than 2m wide x 2m high must be approved by SAP.
  9. Refusal or Withdrawal of your Work(s) by the SAI
    9.1 SAI may accept or decline any Work(s) submitted for the SAP that appear to breach copyright law, any laws or regulations, the reputation of SAP/ CAC or these Terms.
    9.2 The SAI’s decision is final.
  10. Selection and judging
    10.1 All submitted works will be seen by the SAP Selection Panel, who will create a shortlist of works eligible for the online and on-site exhibitions. Selected works will then be sent on to the Judging Panels who will choose the finalists and winners. Selected works will appear on the SAP website gallery page and be curated for an on-site exhibition at the Caudan Arts Centre.
    10.2 Special Prizes: all works in the Best Artist category are eligible for the Special Prizes. The juries in the Best Amateur Artist and Best Young Artist categories may put forward exceptional works to be eligible for the Special Prizes.
    10.3 Selected works will be allocated a reference number in order to remain anonymous for the jury.
    10.4 Jury members’ names will not be disclosed until the winners have been declared, to avoid any external
    pressure.
    10.5 If the jury does not find a good enough work for a particular prize, they may choose not to award the prize.
    10.6 An artist can only win 1 prize.
    10.7 SAI reserves its right to disqualify You at any time during SAP, for dishonesty, voting fraud, obscene language, offensive behaviour, non-compliance with the copyright or any similar intellectual property rights and/or contravention of any of these Terms.
    10.8 People’s Choice Award: by popular vote on the SAP website.
    10.9 The SAP Selection Panel and the SAP Judging Panels’ decisions are final.
  11. Delivery and retrieval of your Work from the Caudan Arts Centre
    11.1 You will be responsible for delivering and retrieving your original artwork/s according to an established
    schedule.
    11.2 Le Caudan Arts Centre cannot be held responsible for works delivered/ retrieved outside of the allocated times and works which are not retrieved after the exhibition.
    11.3 No Work that has been accepted and displayed at the on-site Exhibiton may be removed prior to the close of the exhibition.
  12. Use of Your data
    12.1 The SAI will comply with the Data Protection Act 2018 and associated legislation and process your data in accordance with the SAI’s privacy policy, updated from time to time https://www.samudraartprize.com.
    12.2 The Samudra Art Prize webpage has been created and is owned by Samudra Art Initiative Ltd.
    12.3 By applying to the SAP, You agree that you have read and accept to be bound by the Terms of this clause 12.  As a consequence, You expressly give your consent and agree to the disclosure of Your personal data by SAI to members of the public.
    12.4 Your personal data includes information such as your name, postal address, email address, phone number.
    12.5 Your personal data will be collected and processed in a legal and fair manner, for the following purposes only: (1) Process your application for entry to SAP, (2) Communicate with you and (3) Advertising and marketing
    opportunities. It is clearly understood that given the nature of the SAP, your identity and some other personal data as deemed necessary and agreed by You, may be disclosed to members of the public for advertising and marketing purposes.
  13. Permission for the SAI/CAC to use your Work(s) and/or reproductions of Work(s) and/or Image(s)
    13.1 You grant the SAI/ CAC a non-exclusive, worldwide, royalty free, irrevocable licence in perpetuity to use, reproduce, modify, edit, publish and distribute your Images for archival, educational, publicity, website, press and signage purposes, including through use of mobile applications and social networking sites.
    13.2 You grant SAI/CAC a non-exclusive, worldwide, royalty free, irrevocable licence in perpetuity to sub-licence the rights set out in Clause 13.1 for the purposes of allowing mobile applications and social networking sites to host, use, distribute, modify, run, copy, publicly perform or display, translate and create derivative works of Your Work(s)/ Images on their sites.
    13.3 By submitting a Work(s)/ Image, You agree that members of the public will be allowed to take photographs of the Work(s) (alone or in combination with other Work(s) for personal and non-commercial use during the exhibition period. SAI/ CAC will not be responsible if any such images of the Work(s) are exploited commercially in violation of the permission given.
  14. Permission for the SAP sponsors to use your Work(s) and/or reproductions of Work(s) and/or Image(s)
    14.1 You grant the sponsors of the Samudra Art Prize reproduction rights to Your Work(s) in their sponsored category: filming, broadcasting and/or reproducing the whole or any part of the Work(s) for archival, educational, publicity and marketing (including without limitation on their Website, posters and billboards and all forms of social media), press.
  15. Copyright
    15.1 Artists who have opened an online account retain ownership of all of their copyrights regarding the works of art and information contained in their application form.
    15.2 The finalists and winners grant SAI/CAC a free right to reproduce the content of their artist’s profile and submission form for an unlimited period of time. This right is limited to communications made by SAI/CAC (press releases, publications on the website and on social media, publications at the Caudan Arts Centre, etc).
  16. Personal data
    16.1 SAI/CAC ensure that no personal information will be requested from candidates that is not truly useful for reviewing their application.
    16.2 Candidates agree and accept that their personal data will be processed electronically by SAI under Mauritian law, concerning the protection of individuals with regard to the processing of personal data.
    16.3 In the Artist’s Profile and Submission Forms, applicants are asked to expressly agree to the electronic processing of this data by checking the acceptance box.
    16.4 Applicants have a right to access, object to and rectify data concerning them in the personal accounts reserved for each applicant.
    16.5 Candidates accept and agree that their personal information will be communicated to third parties pursuant to application of the law or for the normal organization of the Samudra Art Prize.
    16.6 Candidates are free to delete their candidate space at any time by clicking on the ‘Delete my account’ button provided for this purpose.
  17. The Samudra Art Prize website
    17.1 While SAI endeavours to ensure that the Samudra Art Prize website is available 24 hours a day, SAI will not be liable if for any reason the webpage is unavailable in part or whole at any time or for any period.
  18. Sale of work(s)
    18.1 For the purposes of any sale of Your Work, the SAI/ CAC’s role is strictly limited to introducing the Purchaser to You. The SAI/CAC does not have any authority to negotiate or conclude the sale of Your Work. All sales of Work(s) shall be subject to the terms of sale You put in place between You and the Purchaser. Any disputes relating to a sale of Your Work shall be resolved directly between You and the respective Purchaser without the SAI/ CAC’s involvement.
    18.2 The SAI/ CAC may provide the Purchaser’s details (including their personal data) to you for the purposes of completing and fulfilling the purchase. You hereby agree to comply with all relevant data protection regulations in respect of such personal data. Please note that the SAI/ CAC’s will not have obtained any consent for You to send marketing or other material, whether electronic or otherwise to the Purchaser and you should obtain such consent if You wish to contact the Purchaser in the future.
  19. Limitation of Liability
    19.1 The CAC/SAI shall have no liability to You whatsoever for any loss or damage howsoever caused.
    19.2 The CAC/SAI shall not be liable for any deterioration or wear and tear to the Work(s), or any loss, damage or destruction (including damage to frames) through the ordinary course of handling the Work(s).
  20. Insurance
    20.1 You shall purchase and maintain with financially sound and reputable insurers, an insurance cover against any liability that may be asserted against, or expenses that may be incurred by any person and/or the art works during the SAP.
  21. Third Parties
    21.1 No third party shall have any rights under or in relation to these Terms.
  22. Force Majeure
    22.1 For the purposes of these Terms, a Force Majeure Event means an event beyond the reasonable control of SAI/ CAC. SAI/ CAC shall not be liable to You under these Terms as a result of a Force Majeure Event.
  23. Severance
    23.1 If a court finds any of the Terms invalid, illegal or unenforceable, that particular Term shall be deemed deleted, and the validity and enforceability of the other Terms shall not be affected.
  24. Entire Agreement
    24.1 These Terms contain the whole agreement between the parties relating to the subject matter of this agreement at the date hereof to the exclusion of any terms.
  25. Law and Jurisdiction
    25.1 These Terms and the contract of which they form part shall be governed by and construed in accordance with Mauritian law. Any disputes arising in relation to these Terms shall be subject to the exclusive jurisdiction of the courts of Mauritius.
  26. Terms, Conditions and Privacy Policy
    26.1 SAI reserves its right to modify, amend and/or vary the present Terms at its discretion. In such case, SAI will use its best endeavours to inform You accordingly, but the onus remains on you to regularly review the website and the Terms to be informed about any latest modification, amendment and/or variation thereto.
    26.2 By ticking the acknowledgement of Terms, Conditions and Privacy Policy box, You acknowledge that You have read and agree with the above Terms, and particularly You hereby give your express consent to your personal data collection and processing according to clause 12 in the manner and for the purposes as stated therein.
